Another Sanctuary Cities Victory Against the DOJ

The Riley Safer team, in partnership with WilmerHale, helped the City of Chicago achieve another victory against the Trump administration on Thursday. The 7th Circuit Court of Appeals upheld Judge Leinenweber's grant to Chicago of a nationwide injunction stopping Attorney General Jeff Sessions from applying new conditions to grant money to force cities across the country to cooperate with immigration authorities. A three-judge panel on the Chicago-based 7th Circuit Court of Appeals agreed that Chicago is likely to succeed in its challenge to Attorney General Sessions’ mandate that cities may receive crime-fighting funds only if they allow federal immigration officials access to detention facilities and provide 48-hour notice before they release an undocumented immigrant. The appellate court’s decision Thursday affirms the district court’s decision to put those conditions on hold nationwide.
